Terms and Conditions (T&C)

The Paragliding Kandertal association (hereinafter referred to as Paragliding Kandertal) offers tandem paragliding flights in the Kandertal and the surrounding Bernese Oberland area to interested individuals and arranges them with independent pilots.

1. registration

With the registration (verbally or in writing), booking via homepage or order/purchase of a voucher for a paragliding flight, you accept the general conditions of contract as part of the contract between you (customer) and Paragliding Kandertal.

When booking for a group, the person making the booking takes responsibility for ensuring that all group members comply with the terms and conditions and is liable for any cancellation fees incurred by all participants.

2. Payment terms

Vouchers must be paid within 10 days. Vouchers are non-refundable, and no replacement or equivalent value will be refunded if lost.

Bookings can be paid by card, Twint, etc., or directly on-site in cash before the flight. If flights cannot take place on the scheduled date due to weather or other circumstances, the amount will be credited for a future flight in the form of a voucher.

3. Prices

The prices listed are for the flight only. This means the costs for mountain railway tickets or transfers are not included. Subject to price changes and printing errors.

4. Rescheduling / Cancellation / Termination by customer

Rescheduling a flight by the customer must be done in writing at least 2 days in advance. If rescheduled later, a processing fee will be charged in accordance with the conditions mentioned under cancellations.

Cancellations are possible up to 36 hours before the agreed time. Already paid flights or vouchers will not be refunded. A voucher will be issued instead.

For cancellations between 36 and 24 hours before the appointment, CHF 100 will be charged.

Cancellations less than 24 hours before the appointment are no longer possible. The full amount must be paid.

Late arrival or no-show is considered a cancellation, and the full amount must be paid. In case of delays, the pilot decides whether the flight can still take place and to what extent. In either case, the full amount is owed.

If the customer aborts the activity, no refund will be issued and any additional costs will be borne by the customer.

5. Cancellation / Rescheduling / Termination by Paragliding Kandertal or the pilot

If weather and natural conditions, safety aspects, force majeure, or other reasons make a flight difficult, hazardous, or impossible, the organizer or pilot may cancel or abort the flight at any time. The amount paid will be issued as a voucher.

The pilot may refuse to fly with a customer if the customer does not follow the pilot's instructions or if the safety of the flight is compromised by other actions. In this case, the full amount is also owed.

6. Flight duration

The flight times listed on the website for the various offers are approximate and depend on the weather. If a flight has to be aborted early due to weather or other external circumstances, the flight will be charged proportionally to the time flown and the remaining amount will be refunded. If a flight has to be aborted early due to circumstances caused by the customer, the full amount of the booked flight is still owed.

7. Voucher validity

Vouchers are valid for 2 years from the date of issue.

8. Conditions of participation / Requirements for the customer

Good health is required for all activities (flight, Hike&Fly). The customer must inform the pilot / Paragliding Kandertal in advance of any health issues of any kind. The customer must under no circumstances be under the influence of drugs or alcohol.

Passengers under 16 years of age require the consent of a legal guardian, in writing if necessary, if no legal guardian is present on-site.

The maximum permissible weight is 110 kg.

The customer agrees to fulfill these conditions of participation and to follow the pilot's instructions. If these conditions of participation are not met or the instructions are not followed, the pilot may exclude the customer from participation. In such a case, the booked flight must be paid for in full.

9. Insurance

Paragliding is not classified as a risk sport and is covered by standard Swiss accident insurance (UVG).

Passengers from other countries (place of residence is decisive) must have appropriate insurance. The customer is responsible for checking their accident insurance coverage and informing Paragliding Kandertal or the pilot about it. Customers are not insured by Paragliding Kandertal or the pilots.

10. Liability

Transportation during tandem paragliding flights is not subject to the liability provisions of the Swiss Ordinance on Air Transport (OAT) of August 17, 2005. By booking a flight or purchasing a voucher, the pilot's liability toward the passenger/customer is contractually limited (flight ticket details may vary depending on the pilot) to CHF 5 million for personal injury and CHF 5,000.— for property damage or loss of items. Liability begins when the passenger is connected to the equipment at takeoff and ends after landing once the passenger is disconnected from the equipment. In all cases, fault on the part of the pilot must be proven.

Paragliding Kandertal arranges booked flights with independent, self-employed pilots. Paragliding Kandertal is not liable for any personal injury or property damage sustained by the pilot or customer. The pilot always bears full responsibility for the customer's safety.

Pilots booked through Paragliding Kandertal have their own equipment and passenger liability insurance and operate entirely independently. The pilots are responsible for maintaining their equipment and ensuring the safety of their customers. Paragliding Kandertal cannot be held liable.

Hike & Fly: For a booked Hike & Fly offering, the pilot is only liable for personal injury or property damage that is directly related to the immediate flight preparation or the flight itself. In any case, fault on the part of the pilot must be proven. Neither the pilot nor Paragliding Kandertal is liable for personal injury or property damage associated with the ascent or descent.

11. Photo and Video Copyright

Photos and videos are the intellectual property of Paragliding Kandertal. Paragliding Kandertal may use this material free of charge for promotional purposes, even if the customer is recognizable in it. If the passenger does not agree to these terms under section 7, they must explicitly notify us before the flight.
