General Terms and Conditions (AGB)

The Paragliding Kandertal Association (hereinafter referred to as Paragliding Kandertal) offers paragliding tandem flights in the Kandertal and the surrounding area of the Bernese Oberland to interested parties and arranges these for independent pilots.

1. registration

With the registration (verbally or in writing), booking via homepage or order/purchase of a voucher for a paragliding flight, you accept the general conditions of contract as part of the contract between you (customer) and Paragliding Kandertal.

When registering a group, the person registering is responsible for ensuring that the general terms and conditions are observed by all participants in the group and is liable for any cancellation costs incurred by all participants.

2. terms of payment

Vouchers must be paid within 10 days. Vouchers will not be taken back and in case of loss no replacement or equivalent will be refunded.

Bookings can be paid in cash via Paypal etc. or before the flight. If flights cannot be carried out on the agreed date due to the weather or other circumstances, the amount for a later flight will be credited in the form of a voucher.

3. prices

The prices quoted are air fares only. I.e. the costs for mountain railway tickets or transfers are not included. Price changes and printing errors are reserved.

4. postponement of the flight date / cancellation / abortion by the customer

The postponement of a flight date by the customer must be made at least 2 days in advance in writing. If the postponement occurs later, a processing fee will be charged in accordance with the conditions mentioned under Cancellations.

Cancellations are possible up to 36 hours before the agreed date. Already paid flights or vouchers will not be refunded. A voucher will be issued.

For cancellations between 36 and 24 hours before the date CHF 100 will be charged.

Cancellations less than 24 hours before the date are no longer possible. The entire amount must be paid.

Late appearance or non-appearance is considered as cancellation and the entire amount must be paid. In the event of delays, the pilot decides whether a flight can still be carried out and to what extent. Either way, the entire amount is owed.

If the customer stops the activity, there will be no refund and any additional costs will be charged to the customer.

5. cancellation / displacement / abortion by Paragliding Kandertal or the pilot

If weather and nature conditions, safety aspects, force majeure or other reasons make a flight difficult, dangerous or impossible, the organizer or the pilot may cancel or abort the flight at any time. The amount paid will be issued as a voucher.

The pilot can refuse the flight to customers unless the customer follows the instructions of the pilot or the safety of the flight is endangered by other actions. In this case, the full amount is also due.

6. flight duration

The flight times indicated on the homepage for the various offers are indicative and depend on the weather. If a flight must be cancelled early due to the weather or other external circumstances, a flight will be charged according to the time flown and the balance refunded. If a flight has to be cancelled early due to circumstances caused by the customer, the entire amount of the booked flight is still due.

7. voucher validity

Vouchers are valid for 2 years from the date of issue.

8. conditions of participation / customer requirements

Good health is required for all activities (flight, hike&fly). The customer must inform the Pilot/Paragliding Kandertal in advance of any health problems of any kind. The customer must under no circumstances be under the influence of drugs or alcohol.

Passengers under the age of 16 require the consent of a parent or legal guardian, if applicable in writing, if no parent or legal guardian is present.

The maximum permissible weight is 110 kg.

The customer undertakes to fulfil these conditions of participation and to follow the instructions of the pilot. If these participation conditions are not fulfilled or the instructions are not followed, the pilot can exclude the customer from participation. In such a case, the booked flight must be paid in full.

9. insurance

Paragliding is not a risky sport and is covered by the normal Swiss accident insurance (UVG).

Passengers from other countries (domicile decisive) must have appropriate insurance. For an additional contribution of CHF 20, customers from abroad will receive additional insurance for accident coverage of CHF 5 million if there is no or insufficient private accident insurance. The customer is obliged to inform himself about his accident coverage and to inform Paragliding Kandertal or the pilot about the accident coverage. The customers are not insured by Paragliding Kandertal or the pilot.

10. liability

Transportation on tandem paragliding flights is not subject to the liability provisions of the Ordinance on Air Transport (LTrV) of 17.08.2005. The liability of the pilot vis-à-vis the passenger/customer is contractually limited to CHF 5 million for personal injury and CHF 5,000 million for damage to property or loss of objects upon conclusion of a booking or purchase of a voucher (flight ticket varies depending on the pilot). Liability begins with connecting the passenger to the aircraft at take-off - and ends after landing with disconnecting the aircraft from the passenger. In any case a fault of the pilot must be proven.

Paragliding Kandertal arranges the booked flights for independent, independent pilots. Paragliding Kandertal is not liable for personal injury or material damage to pilot or customer. In any case, the pilot bears full responsibility for the safety of the customer.

Pilots mediated by Paragliding Kandertal have their own equipment and passenger insurance and are completely independent. The pilots are responsible for the maintenance of their equipment and the safety of their customers. Paragliding Kandertal can not be held liable.

Hike & Fly: In the case of a booked Hike & Fly offer, the pilot is only liable for personal injury or property damage directly related to the immediate flight preparation or the flight itself. In any case, fault on the part of the pilot must be proven. Neither the pilot nor Paragliding Kandertal shall be liable for personal injury or damage to property in connection with the ascent or descent.

11. copyright photo and video

Photos and videos are copyrighted property of Paragliding Kandertal. Paragliding Kandertal can use this material free of charge for advertising purposes, even if the customer can be recognized on it. If the passenger does not agree to these provisions under point 7, he/she must explicitly state this before the flight.
